USER AGREEMENT

PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

This Agreement contains the terms and conditions that apply to your ("Customer") purchase of any product, good, services or materials ("materials") from Liberty Enterprises, Inc. and its affiliated entities ("Liberty") or use of Liberty's Web site. By using Liberty's web site or accepting delivery of products or services from Liberty, Customer agrees to be bound by and accept these terms and conditions. These terms and conditions are subject to change without prior written notice at any time, in Liberty's sole discretion.

Liability Disclaimer. LIBERTY AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF ITS PRODUCTS AND SERVICES, THIS SITE OR ITS CONTENTS. LIBERTY'S PRODUCTS AND SERVICES, THIS SITE OR ITS CONTENTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LIBERTY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE INTERNET BASED PRODUCTS AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND REPRESENTATIONS OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND INFRINGEMENT. IN NO EVENT SHALL LIBERTY AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF ITS INTERNET BASED PRODUCTS AND SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF LIBERTY, ITS AFFILIATED ENTITIES OR ANY OF ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, LIBERTY DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT.

THIS SITE COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN; LIBERTY MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE PRODUCT(S) AND SERVICES OFFERED AT THIS SITE AT ANY TIME.

Liberty assumes no responsibility for any encrypted data that is sent to, stored on, or retrieved off of a Liberty server. The technology used to encrypt data being transmitted to or from Liberty's server is licensed by Liberty and Liberty makes no claims or warranties regarding the viability, integrity, or robustness of the encryption used. Further, Liberty is not responsible for the success or failure of the server to properly encrypt data. By using the server, Customer assumes the risk that the encryption algorithm may be broken so that the data being transmitted is visible to others. Liberty assumes no responsibility for any commercial transactions attempted or completed involving any Liberty product or service or the third party software and other products and services designed to enable such transactions used by Customer. Customer's rights and obligations with respect thereto are subject solely to any agreement(s) between Customer and such third party.

Use. Customer agrees to use the products and services only for their intended use. In no event shall the product or service be modified by Customer without the express written authorization of Liberty. Liberty, for its part, agrees to maintain all Customer information provided in a confidential manner. Liberty will not provide this information to any third parties unless these parties are an integral part of completing the transaction. In no event will Liberty use the Customer information for purposes other than those intended without the express written authorization of Customer.

Reliability. Customer understands that the general reliability of the Internet and of connections to and from the Internet may be controlled by factors beyond the reasonable control of Liberty. Because of this, it is impossible for Liberty to guaranty that Liberty's provision of the products and services will be provided without error or interruptions. Once Liberty has been informed that the product or services have been interrupted, that Customer or others have been unable to access or use the products or services, or that there is an error in the product or services, Liberty will make reasonable commercial efforts to correct such problem or error in a timely manner.

Liberty recognizes the importance of Internet security and is fully committed to protecting unauthorized access to customer information. Liberty, as part of this Agreement, will continuously employ and maintain a network firewall and other security features that Liberty deems appropriate from time to time (e.g., Secure Socket Layers, password protected logons, server logs, access control restrictions etc.) in an effort to prevent disruption of service or loss, theft or alteration of sensitive information. Liberty agrees to use reasonable commercial efforts to stay current with frequent changes in security requirements which may include participation in Internet security trade organization, conferences, educational activities, use of security consultants, periodic intrusion tests, software upgrades, hardware enhancements or through proactive security systems monitoring. The parties agree that such efforts represent a good faith effort on behalf of Liberty to maintain appropriate security levels. Customer acknowledges that, in spite of these good faith efforts, Liberty cannot guarantee that a security breach will never occur and that liability disclaimers set forth in this Agreement, will also apply to security-related events.

Privacy and Security. Please refer to the Privacy and Security policy contained on this site which terms are hereby incorporated into this Agreement.
